(haipo) The Haifa District Court sentenced Elhain Warko to 26 years in prison, after he was convicted of the intentional murder of Musa Ismail Abakar, aged 28, September 2021. In addition to the prison sentence, Warko was ordered to pay 258 shekels in compensation to the deceased's estate. The murder occurred following a confrontation between two gangs.
Violent assault that led to the death of the victim
The verdict indicates that following a confrontation that developed between two gangs, Warco and three others attacked the deceased with severe violence. Warco hit the deceased in the head with a wooden plank and continued to beat him even after he fell to the ground, while the three others joined the attack by kicking and throwing stones. As a result of the fatal injuries he suffered, the deceased was pronounced dead. An indictment was filed against the four involved in the incident, and Warco's case was heard to its conclusion, when after hearing the evidence he was convicted of the crime of intentional murder.
Three additional partners were convicted as part of plea agreements.
During the legal proceedings, three of those involved were convicted as part of plea bargains. Aijajum Yua Tsepai was convicted of aiding and abetting murder and sentenced to eight years in prison. Balta Basha and Geshav Mengstu were convicted of indifferent murder and each sentenced to 18 years in prison. The degree of criminal responsibility of each of the four involved was thus determined according to their role and involvement in the fatal incident.
The prosecution emphasized the seriousness of the acts and the violation of the sanctity of life.
As part of the arguments for the sentence, the prosecution, through Attorney Yair Goichman of the Haifa District Prosecutor's Office (Criminal), emphasized the seriousness of the acts and the serious violation of the sanctity of life, bodily integrity, and public safety. The prosecution emphasized that the deceased and his friends were on the run when they were attacked, and that Warko hit the deceased from behind and continued to hit him even after he fell to the ground and was helpless. The prosecution also noted that the deceased, who came to Israel to support his family, left behind parents and siblings, and that his death left an entire family with severe loss and trauma.
Court: Warko was the central figure in the incident
The court accepted the prosecution's position regarding the seriousness of the acts and determined that Worko was the central and dominant figure in the incident, the one who led the attack, was the first to hit the deceased and continued to hit him even when he was lying helpless on the ground. At the same time, the court determined that the circumstances of the case are not among those exceptional cases that justify imposing a life sentence. Therefore, the court sentenced Worko to 26 years in prison and compensation in the amount of 258 thousand shekels to the deceased's estate.
