The District Court in Jerusalem today (Tuesday 27/12/22) accepted the petition of the residents of Dania in Haifa and annulled the decision of the district committee, which approved the "Green Dania" plan.
Today (Tuesday) in the District Court in Jerusalem, Judge Eli Abarbanel accepted the claim of the petitioners, according to which the "Green Dania" program could harm the safety of the residents of the neighborhood. Judge Abarbanel stated in the ruling that the district committee that approved the construction did not take into account the opinions expressed before it, regarding the possibility of a fire trap being created in the Dania neighborhood if a fire breaks out and the residents of the neighborhood are forced to evacuate quickly. The judge noted that today there are two exits from the Dania neighborhood that drain into one axis - Abba Khushi Street.
According to the judge, the district committee did not examine the expected traffic loads at the intersections connecting the neighborhood to the Abba Khushi axis during an emergency, nor the expected confrontation during it. The judge pointed out that the whole issue should be considered by a professional, in order to understand what the residents will be required to do during an emergency and if the new plan could increase the risk they will find themselves in.
Judge Abarbanel further noted that even the creation of buffer zones in the neighborhood would not be enough to prevent the spread of fire to the Dania neighborhood, even if the buffer zones would improve the situation to a certain extent, and even demanded to find a solution for access and escape routes during a fire beyond that, even before the "Green Dania" was approved. In addition, the judge rejected the solutions brought by the transportation consultant on behalf of the respondent and said that the district committee did not at all examine the possibility of evacuation by dedicated public transportation during a fire.
The judge also rejected the respondent's claim, according to which the amount of vehicles that will be added to the neighborhood as a result of the construction of 226 new housing units and a hotel is negligible, and added that it is clear that the residents of the neighborhood are very afraid of the addition of hundreds of vehicles to the area. The court also accepted the petitioners' argument that the risk of a large fire breaking out is not merely theoretical, but is a real threat to a large residential neighborhood.
"The committee's decision that it is possible to be satisfied with the existing traffic infrastructure for the escape of the residents of the neighborhood in an emergency is not based on a professional opinion regarding the assessment of the expected traffic loads on the neighborhood's roads and exit junctions during the evacuation of its residents and regarding the duration of the residents' departure from the neighborhoods under these conditions. Therefore, in the committee's decision and the plan that is the subject of the petition "There was a meeting that required their cancellation."
