(haipo) - A significant decision was made by the appeals committee regarding the preservation of 38 TMA, which has a significant impact on the residents of Carmel. The committee accepted the claims of attorney and architect Lior Detz, attorney Uri Shilo and landscape and preservation architect Hana Yufa, according to which the preservation committee must discuss and justify its decisions in case it wishes to deviate from the conservation policy. This decision is expected to affect dozens of applications currently before the committee the local, referring to TMA 38 in the old Carmel neighborhood.
The appeals committee recently discussed the appeals filed regarding the TMA plan at 17 Margalit Street in the Shambor neighborhood in Haifa. In March 2023, a TMA project was also carried out in a nearby building - 15 Margalit, and there are other buildings on the street that are in a similar situation. The application submitted for 17 Margalit Street includes the demolition of a three-story building above a shelter (5 housing units) and the construction of a new 6.5-story building, which includes an underground parking floor (13 housing units). Attorney Shai Weinberger, representing the local committee, explained that 17 Margalit Street is in a conservation complex, and therefore the request for a permit was forwarded to the conservation committee for discussion. She stated that the local committee's position is that the main goal of conservation in the complex is to protect the nearby stairs, and the building itself has no values Weinberger added that the preservation committee also decided to avoid interfering with the stairs, so the local committee approved an exception from the conservation policy regarding the number of floors.

According to him, if this decision is accepted, it may be in conflict with the decisions made regarding the other buildings, thus creating a lack of uniformity in the field.
The developer explained that elderly tenants live in the building, and he faces another problem - a building built at 24 Margalit Street, which completely blocked the northern view of the tenants. In addition, the developer referred to the state of the stairs in the building, and noted that anyone who would have noticed the existing state of the stairs, would have turned to the local committee and asked for an urgent renovation.

The appeal committee determined at the end of the hearing that even though the building is in a preservation complex in the Shambor neighborhood, the local committee applied to the request the rules relating to the Carmel neighborhood complex. As a result, an addition of 2.5 floors was approved, and the new building is expected to have 7 residential floors, above street level. After the conservation committee receives an updated decision, the local committee will be able to return and discuss the request for a permit. In addition, the appeals committee addressed the question of whether 17 Margalit Street is included in the conservation complex, and stated that the policy document is clearly worded according to which the street is indeed included in the conservation complex.
