"From now on the conservation committee will be required to provide reasons every time it requests to deviate from the conservation rules"

(haipo) - A significant decision was made by the appeals committee regarding the preservation of 38 TMA, which has a significant impact on the residents of Carmel. The committee accepted the claims of attorney and architect Lior Detz, attorney Uri Shilo and landscape and preservation architect Hana Yufa, according to which the preservation committee must discuss and justify its decisions in case it wishes to deviate from the conservation policy. This decision is expected to affect dozens of applications currently before the committee the local, referring to TMA 38 in the old Carmel neighborhood.

The appeals committee recently discussed the appeals filed regarding the TMA plan at 17 Margalit Street in the Shambor neighborhood in Haifa. In March 2023, a TMA project was also carried out in a nearby building - 15 Margalit, and there are other buildings on the street that are in a similar situation. The application submitted for 17 Margalit Street includes the demolition of a three-story building above a shelter (5 housing units) and the construction of a new 6.5-story building, which includes an underground parking floor (13 housing units). The petitioners claim that according to the policy plan in the area, it is possible to build up to three stories above columns, a total of four stories, and above them an attic, that is, five stories in total.

Protect the stairs

Attorney Shai Weinberger, representing the local committee, explained that 17 Margalit Street is in a conservation complex, and therefore the request for a permit was forwarded to the conservation committee for discussion. She stated that the local committee's position is that the main goal of conservation in the complex is to protect the nearby stairs, and the building itself has no values Weinberger added that the preservation committee also decided to avoid interfering with the stairs, so the local committee approved an exception from the conservation policy regarding the number of floors.

"The committee decided that only the Dan moat has conservation value"

Later in the discussion, attorney Inbar Ado, representing Reef Carmel Ltd., claimed that the conservation committee was fully exposed to the plan and referred to the stairs (Mashul Dan), but not to the volumes and the shape of the building. "We presented the entire construction issue, the units and the construction instructions to the conservation committee," he said. "They stated in their decision that they were presented with all the elements of the plan, and that they are responsible for the values for conservation, but no specific reference was given to this whole. In the end, they decided that the only conservation value is Meshol Dan."

Parking and transportation problems in the area

Another resident from the Margalit 21 area claims that the local committee did not pay enough attention to the issue of transportation and parking in the area. According to him, the outgoing city engineer, Ariel Waterman, presented a dire picture of the transportation situation in the area, and according to him, the presentation he presented indicated that no more buildings should be added on the street. Since that show, the resident points out, a significant number of buildings have been added to the street, which worsens the traffic and parking congestion.

Attorney Ado added and argued that the neighborhood must be examined with a holistic approach, and it is not possible to make an individual decision regarding one building out of ten houses, for which the TMA 38 plan was approved, without taking into account the consequences for the other buildings in the neighborhood. According to him, if this decision is accepted, it may be in conflict with the decisions made regarding the other buildings, thus creating a lack of uniformity in the field.

The developer explained that elderly tenants live in the building, and he faces another problem - a building built at 24 Margalit Street, which completely blocked the northern view of the tenants. In addition, the developer referred to the state of the stairs in the building, and noted that anyone who would have noticed the existing state of the stairs, would have turned to the local committee and asked for an urgent renovation.

"The request has not been exhaustively reviewed"

The appeal committee determined at the end of the hearing that even though the building is in a preservation complex in the Shambor neighborhood, the local committee applied to the request the rules relating to the Carmel neighborhood complex. As a result, an addition of 2.5 floors was approved, and the new building is expected to have 7 residential floors, above street level. However, if the application had been examined according to the rules of a preservation complex, it would have been necessary to reduce at least one residential floor. The appeals committee noted that the conservation aspects and their effect on the building's height were not examined exhaustively, neither by the conservation committee nor by the local committee. Therefore, the committee decided to return the request for reconsideration by the conservation committee and the local sub-committee.

The decision of the appeal committee states that since the building at 17 Margalit Street is in a conservation complex, the discussion at the conservation committee is an important part of the licensing process, therefore it must be discussed anew. After the conservation committee receives an updated decision, the local committee will be able to return and discuss the request for a permit. In addition, the appeals committee addressed the question of whether 17 Margalit Street is included in the conservation complex, and stated that the policy document is clearly worded according to which the street is indeed included in the conservation complex.

"Now the conservation committee will no longer be able to evade"

"We won again, Uri and I" (*Advocate Uri Shila), said yesterday, Tuesday, 10/12/24, Adv. Lior Datz. "The appeal committee accepted our positions and determined that the conservation committee did not do its job, and so did the local committee, which did not examine the request in accordance with the conservation policy and TMA 38. If the request had been examined, a reduction of one and a half floors would have been necessary. To deviate from the conservation policy, the committee must examine the request, make a decision and justify its position, including the conservation committee. Now, the request goes back to the conservation committee and the local committee, and the chairman of the conservation committee will not be able to avoid and will have to express his position"

  1. A lot of housing estates in the Carmel area, in contrast to underprivileged housing estates such as Nove David / Shprintsek, etc. mainly improve the situation of those who are already improved.

  2. excellent. Making a conservation joke. And what's worse, all the new buildings are the same and boring. Destroying the city

  3. The loyal reader's explanations and descriptions have long been known, and describe a bleak and worrying reality.
It is interesting that no one in the municipality saw fit to change the delusional processes, to pass a resolution to change the policy. The greedy lead the Carmel ridge to total destruction, under the auspices of the municipality.
Let us, the residents, who want to live in peace and quiet, who want to protect their apartment from the greedy, continue like this.

  4. The TMA 38 plan is a bad and destructive plan, a flawed implementation in places that are not required at all for strengthening buildings, a plan based entirely on false statements by the municipal engineer, on flawed reports from the laboratories on behalf of the developer and on faulty static calculations made by the developers' engineers.
All defective approvals for the granting of a building permit pursuant to TMA 38 are given in a targeted manner by the local committee with the encouragement of the municipal legal counsel and in cooperation with the Haifa district appeals committee. These are flawed procedures that are against the law.
In the near future, this issue will be discussed in the Haifa District Court as part of an administrative petition filed by a group of tenants in Carmelia against the District Appeal Committee and the Haifa Local Committee.
We will wait for the results that are expected to cause a revolution in the construction permit procedure by virtue of TAMA.

    • What a beauty! You added more bureaucracy to the already overloaded system and caused people to avoid doing TMA 38 in Haifa! Wow, what an achievement... :/

  5. A city that treats entrepreneurs in an evil way and smuggles them out, and then they are surprised that there is nowhere to live and that the prices are flying
Exactly which buildings are there to be preserved on Margalit Street, every building that opposes in a year will also request a permit for the TMA, elderly people have to leave their houses because of their eyesight problems

    • Dark reaction, precisely the adults have every right to live in their property, they have rights, as veterans they also have something to say, and all the greedy people should understand this!!

    • No place to live? Are the masses fighting over Haifa? We live here near Huadi by the sea. Beautiful stone houses immersed in green. The new and excessive construction will only drive people away. Why don't you try rounding a balcony? paint a different color? the building Design a building that is beautiful to look at and pleasant to live in. Maybe even leave some trees? The new construction is construction that only people who hate themselves build.

  6. The carmel is finished
The addition of 1800 vehicles in each neighborhood as a result of the addition of 700 new apartments is another addition to increasing sustainability in each neighborhood.
Addition of hundreds of service provider vehicles, trucks, technicians and couriers. Huge traffic jams in the ridge, currently about 20 minutes from the center of Carmel to Horeb. With the addition of vehicles in Givat Zemar, under construction in the center of Carmel, the slopes of Haifa Naot Peres and Navon - by 2030 the doubling of the traffic jams between the center of Carmel and Horeb.

    • Indeed the Carmel and its special character are destroyed by wild beech of houses when the payment to the municipality for this destroys the character of the Carmel and brings down on the population there the freedom of an area with culture and character for many years.

  7. all due respect! It's time to respect the city's history a little more and not destroy it for the benefit of the real estate agents. Just now they destroyed a special building on 1 Ma'ayan Street, which was among the first on the street and which was designed by the engineer Klitsky. Despite the preservation survey. Not everything should be preserved, but it is appropriate that the Not easy in demolishing any building in favor of monsters.
