The administrative suspension order for "Sushi Dania" in Haifa was cancelled

(haipo) - The administrative cease and desist order issued to "Sushi Dania" in Haifa following the Ministry of Health's audit from 12/8/24, was canceled this morning (Sunday), after the main deficiencies found in the audit were addressed.

After a cease-and-desist order was issued to "Sushi Dania" in Haifa, following sanitary deficiencies found during the Ministry of Health's audit, the cease-and-desist order was canceled this morning (Sun. 18/8/24).

The Ministry of Health informed Lahi Pa:

I would like to inform you that pursuant to section 20 of the Business Licensing Law 1968 (hereinafter: "Business Licensing Law") I hereby issue an administrative cease and desist order (closure order), commanding you and/or any other person acting on your behalf to cease Immediately stop the operation of the business in question, "Sushi Dania" located at 2 Liberia St. Haifa and which you own (hereinafter: "the business"). As part of the order, the business must be closed immediately without the entry of customers, without operations of food preparation, without taking out and bringing in goods, and without any Other activity in the framework of the business. I issue the administrative suspension order for the business in light of the audit findings conducted on 12.8.24 by the inspector of our office. The audit report is marked as appendix "A" and is an integral part of the order.

In this audit, serious deficiencies were found that substantially endanger public health. The main deficiencies are detailed below:

• It was found during the audit that fish and meat after disassembly and some after cooking are frozen for future use contrary to what is allowed. Destroyed by the kitchen workers: 4 kg of fish and 2 kg of ground meat.
• There is no dedicated section for handling fish and it was found that fish are handled at the front bar position. During the inspection, it was observed that the employee of the place handles a large amount of fish waiting outside and those that have been cut also remain outside until the treatment of all the fish is completed. It was found that the temperature of the fish is the same as the room temperature.
• After handling the fish, they are kept in a general refrigerator with vegetables. which may cause cross-contamination.
• At the front bar station there is a refrigerator on the bar where the pieces of fish are kept for the purpose of preparing the sushi, the fish must be kept at a temperature of 2°C but during the inspection it was found that this refrigerator is not working properly which could cause the fish to spoil.
• Eggs and bar preparations are stored in the front refrigerator used to sell drinks. Risk of cross contamination.
• It was found that boxes of vegetables are kept on the open bin in the center of the kitchen.
• In the kitchen, many cartons and garbage were seen that had not been removed, the level of cleanliness in the kitchen is poor.
• Much of the equipment in the place is worn and rusty. Part of it is held by street stones in order to prevent it from falling.
• There is no refrigerator for raw vegetables and they are under the sink next to the cleaning materials. Danger of poisoning.
• Unfit food was destroyed by the kitchen workers: noodles from the date 9/8 (3 kg), and soups frozen for future use 10 kg.
• There is no dedicated refrigerator for thawing meat and poultry and these are thawed and stored after treatment and processing without separation together with vegetables, eggs and various foods. Furthermore, the food boxes are not covered and thus the risk of cross-contamination is great. Also, this refrigerator is in poor maintenance condition.
• There is no separation in the freezer and frozen poultry and fish are stored together with "dim sum" and other foods.
• Rice after cooking intended for rolling the sushi is reinforced in a plastic cooler at the front of the bar. Also, the cooler is not clean.
• The bar area is not clean and tidy, the floor is sticky with a funnel of dirt or leftover food and emits a bad smell.
• The business warehouse is in the basement of the complex. The rice sacks are kept outside the warehouse in an area accessible to rodents and pests.

On 15/8/24 I held a hearing for you regarding the possibility that I will issue an administrative cease and desist order to your business. As part of the hearing, you made a statement about the corrective actions carried out in the business up to the date of the hearing. Yes, you stated that you do not intend to operate the business until the deficiencies are corrected. However, it emerged from your words that many fundamental defects have not yet been corrected, and that you will need some additional time to correct them.

At the end of the hearing, I got the impression that the situation in the business still endangers public health, and that many fundamental deficiencies have not yet been addressed. I will also note that we are talking about Susia - a very sensitive food business. Under the circumstances described, the situation in the business endangers public health, and therefore I decided to issue an administrative cease and desist order to the "Sushi Dania" business. The applicability of this order is immediate. The "Sushi Dania" business must be closed without any activity from the moment this order is received. This order was issued after consultation with attorney Maiser Abahari, chief assistant to the legal advisor.

• Pursuant to Section 22 of the Law, you may request the cancellation of this order from the Magistrate's Court or a local affairs court which is authorized to cancel the order or approve it, with or without modifications. Submitting the request will not delay the execution of the order, as long as the court has not decided otherwise.
• According to section 25 of the law, those who do not comply with a cease and desist order are sentenced to imprisonment for a period of up to 18 months.
• In accordance with section 24 of the law, I order the Israel Police to take the necessary measures to ensure compliance with the instructions of the order and to bring about the immediate cessation of the aforementioned business.
• In accordance with section 21 of the law, this order will remain valid for up to 30 days, but I may request an extension from the Magistrate's Court or the Local Affairs Court, which may extend the validity of the order without a time limit. Submitting a request to the court as mentioned will extend the validity of the order by 7 days.
