(haipo) - The "Talli Orot" association, which operates the "Alma" school for ultra-Orthodox girls in Haifa, petitioned the district court against the Haifa municipality, after canceling its allocation for the school building.

The association, through lawyers David Dror and Yuval Grinstein, is asking the court to cancel the city council's decision of 2/7/24, according to which it must return the school building to the municipality.

The association also requests that the court order the municipality to refrain from contacting the parents of the schoolgirls to inform them about the intention to close the school. Through several orders, the association seeks to prevent the municipality from carrying out any action that would lead to the closing of the school, and even more, to assist the association so that it can renew its institution's symbol in front of the Ministry of Education. The lawyers emphasize that about 100 female students were enrolled in the school, that now, when the school year is about to begin, there is no possibility of preventing them from continuing their studies.

The association "Talli Orot" operates educational institutions - yeshiva, inclusive, kindergartens and schools, among others the "Alma" school in Haifa, a Torah school that includes middle school and high school, on Derech Hayam street in Haifa.

In the petition, the lawyers claim that the reason for trying to close the school is motivated by extraneous considerations of the new government in Haifa. According to them, already in June of last year, the municipality was informed that the school is a growing school, in which both Haifa students and students belonging to the metropolis, but who are not Haifa, study there, and emphasize that when the municipality approved the allocation last year, it knew exactly where each of the students lived And yet the allocation was renewed. In addition, according to the petition, female students who come from outside of Haifa cater to Haifa female students when they enable the existence of the school.

"Discrimination for the sake of discrimination"

In the petition, the association claims that the only reason the municipality decided to cancel the allocation this year is the results of the recent municipal elections and the desire of the mayor, Yona Yahav, to narrow the steps of the students: "What and nothing - discrimination for the sake of discrimination and a desire to damage and fail an educational institution, and all this when the municipality has no substitute or an alternative school, and not even an alternative need for this area. The things are easy and material, in light of the fact that the municipality continues to use educational buildings contrary to their designation and the procedures of the Ministry of Education for the use of professionals or employees of the municipality and not at all for schools and educational institutions."

In the petition there is also a reference to the fact that the association, according to an agreement with the municipality, invested millions in the renovation of the building and other municipal buildings, the students relied on the fact that they would start studying in September 2024 at the school and the teachers assumed that they would continue to work there (the teacher can be notified of the non-employment only until 31/05 /24 - when the municipality's notification of the end of the allocation arrived after this date).

Also according to the petition, last year, when the permission for the building was approved, the municipality was aware that the number of female students outside of Haifa was greater than the number of female students in Haifa, and yet the permission was approved. Moreover, the municipality even claimed that in the list of female students that the association forwarded to it, there are also female students who do not study at the school at all. The association claims that this was a mistake in good faith, and that the list of all the female students who carry out activities in the high school building (during the summer, for example) was forwarded. According to her, the mistake It was corrected immediately when the municipality commented on it. According to the petitioner, there were defects in the first council meeting held on the subject of the school (on 4/6/24) and that the summons for the hearing (which took place on 26/6/24) was made two days in advance.

Another claim that comes up in the petition is that the municipality does not need the school building at all, and that in the compound where the school operates there are two other buildings built by the Ministry of Education that are not used for educational purposes. The association claims that it is not reasonable to evict it from the building when it is not known at all what the municipality intends to do with it, and this when there are two other nearby buildings that are not used for educational purposes.

In the petition appears a letter from the head of the director of education and youth, Ilana Truk, dated 26/6/24, in which she states that 110 female students study at the school - of which 72 are foreign students, one student who appears on the list submitted by the school studies in the glory of Shlomo, 12 Haifa students study In practice, in other schools in the city, 17 female students have already completed their studies, 4 female students who do not exist in the system, 6 female students without placement and 3 female students with a placement note for the Alma School.

According to the petitioners, the correct figures for the 110 academic year are 38 female students, of which XNUMX are from Haifa and the rest are from the Haifa metropolis. Referring to this, the petition states that there are many other schools in Haifa where foreign students study, and the particular case in which Yahav ordered the schools to accept Druze students who live in the city is noted In Dalit al-Carmel and Usafia.

As a reminder, the association received a municipal building for its activities back in September 2020. Now the association requests that the court prevent the municipality from getting the building back by sea, because the reasons according to which the courtyards were used improperly and about difficulties surrounding the list of female students, are baseless.
