On 9/6/24, an audit was conducted at the business in question by the food service inspector at our office.

In this audit, it was found that the main deficiencies observed in the business were corrected. In light of this, the danger to public health has been removed. It is clarified that the cancellation of the order does not constitute a production license, and that you must complete the process of obtaining a production license as required. Manufacturing activity without a manufacturing license constitutes an offense against the law.

The reasons for issuing the order:

On 23/5/24 an audit was conducted in this business by the food service inspectors at the Haifa Health Bureau. This audit found many serious deficiencies that pose a danger to public health.

The main deficiencies found are:

• Damaged infrastructure in part of the business, including the cafe kitchen. The business is undergoing renovations
  without separation between the renovation areas and the active parts of the business.
• Poor sanitary conditions in the business.
• Crossovers between raw food and ready-to-eat food in storage and production.
• Many raw materials, including sensitive raw materials, have expired.
• The business operates without a production license in violation of the Public Health Protection (Food) Law, 2015.

Hearing before issuing the order

On 23/5/24 a hearing was held regarding the consideration of issuing an administrative restriction order to the business in accordance with section 290(f) of the Food Law. At the hearing, she stated that since the audit, cleaning and renovation work has been carried out in the business, which will be completed at the beginning of next week. It was stated by you that the production of food in the pastry shop and the preparation of food in the kitchen of the cafe have been stopped and will not be resumed until the completion of the renovation work and the completion of the correction of the defects.

As a result, I delayed my decision regarding issuing the order. However, I clarified at the end of the hearing that if it turns out that production and food preparation operations are still being carried out at the place contrary to the statement, an order will be issued immediately without further hearing.

After the hearing, an audit was conducted at the business by the Food Service Inspector, in which new bakery products were found filled with creams and decorated with fruits that were not present at the time of the previous audit, which indicates the continuation of productive activity at the location. Salads and washed fresh produce were also found bearing a preparation date of the last day or two. That is, the productive activity and the activity of the buffet kitchen in the business was not stopped, contrary to what was stated.

Since the business is still undergoing renovation work in the work areas, some of the essential renovation work such as closing openings to prevent the entry of insects and flies, placing a sink in the production area has not yet been completed, it is not possible to produce and prepare food in a safe manner that will not ensure its contamination. The works do not even allow the goods and equipment in the business to be placed in a suitable place so that there is still a danger to public health from operating the business in its existing format and in its current state. Under these circumstances, I issued the administrative restriction order. The applicability of this order is immediate. The business must be closed without any activity from the moment this order is received.
