Lincoln Hills - a never-ending saga • The landowners petitioned (again) against the Haifa municipality

(haipo) - Owners of land on the slopes of Lincoln in the estate, submitted an administrative petition to the district court in Haifa, against the municipality of Haifa, claiming that the municipality is not promoting the construction plan in the area. It is about 350 dunams of land, located below Harofeh Street and above Freud Street, in a zoning that has been approved for residential use since before the establishment of the state. The land is privately owned by more than 80 landowners and about 2,000 housing units are supposed to be built on it.

According to the petitioners, the reason why construction is not starting is the claim of the local planning and construction committee that the area must be re-planned.


Attempts to build on the land began in the 90s

Attempts to promote a construction plan on the land of Lincoln Hills began as early as the 90s of the last century. Later, in 2013, a plan was submitted that refers to construction in the area, but at the end of the objection discussions, the landowners discovered that the local planning and construction committee had changed its position and asked to create a new plan.

Following the continuation of the proceedings, in 2019 the landowners submitted an administrative petition against the Haifa Municipality to the District Court in Haifa. The petition ended in an arrangement that was validated by the PSAD, which included a detailed schedule for bringing the plan to the local committee for discussion within six months, as well as milestones for advancing the plan within a year.

The court ruled that within two months a construction and road plan will be completed for the benefit of an economic review. The second step will be to complete an economic review within four months and bring the plan to the local committee. The third step will be the completion of the plan documents and submission to the local committee within four months. The last step should be within two months the review of the documents and bringing them to the local committee for a recommendation for the deposit.

The second step has not yet been carried out

The first phase was completed in less than two months, but the second phase, scheduled for four months (that is, until July-August 2021), is prolonged and stretched until this day - that is, more than 18 months instead of four months.

Despite repeated appeals to the municipality, the landowners did not receive any response, therefore, in recent weeks they submitted another petition to the district court, through the lawyers Assaf Ironi and Anna Eliashkevich from the office of Sh. Friedman Abramson, demanding that the Haifa municipality advance the construction plan for the area in accordance with the agreement reached in court.

Judge Ron Shapira scheduled the petition for an early hearing, on June 20, and noted in his decision: "It appears that the parties have been dealing with the issue since 1998, about two years before I arrived at the Haifa District Court. In the previous petition, an agreement was drawn up and apparently the agreements did not lead to implementation. Since time is not running out Queen, it seems the time has come to clarify the continuation of the procedure."

All this, when it is well known that the housing crisis in Israel, and especially in areas of demand such as the Carmel Ridge in Haifa, requires the promotion of planning procedures for the addition of housing units on quick, or at least reasonable and acceptable, schedules."

This is already the second petition that the landowners in the area have submitted. In 2019, they filed another administrative petition against the municipality, demanding that they be required to promote the plan. The court set a schedule for the plan to be discussed before the plenary of the local committee. The first step is to complete a construction and road plan so that it can be tested financially (within two months). The second phase, which should last 4 months, includes completing the economic review and bringing the plan to the local committee. While the first phase was completed according to the times set, the second phase, which was supposed to take only 4 months, has not yet been completed, even though we are close to two years past the end of the allotted time. For this reason the petition was submitted."

The original plan, HF/2185A, is the plan on which the tender won by the Parshkovski company is based, except that this was won on the ice since this plan is not applicable at all, certainly it is not possible to carry out according to it, at least in recent years and for a long period of time in the future, paving and development arrears which are a condition for obtaining a building permit on the spot (the works being carried out by the Haifa Municipality are illegal and for which a building permit will not be issued).
      Of course, okra permits per se also cannot be obtained. It is important to know that there is no solution for water supply, and the new construction project that the Haifa Municipality is trying to arrange for water supply will never be approved, since it destroys a neighborhood of over 1,000 apartments - Ramat Eshkol B, this failure is certainly not my fault and I oppose it.
