On the one year anniversary of the "Guardian of the Walls" operation, the prosecutor's office publishes the data on its handling of the incidents so far. 118 indictments were filed in the Haifa district against rioters. 2 defendants of Jewish origin and 116 defendants of Arab origin.

About a year after the start of Operation "Guardian of the Walls" and the riots that preceded it in Jerusalem during the month of Ramadan 2021, the State Attorney's Office is publishing data about its handling of the events so far. The data shows that since April 2021 until now, the prosecutor's office has filed indictments against approximately 616 defendants.

The prosecutor's office explains that when it became clear that this was a large-scale unique event, the prosecutor's office decided on a special preparation that included, among other things, a decision that any attribution of the crime of "terrorist act" would be approved by the head of security in the prosecutor's office or the deputy assistant to the state attorney (special duties) , in order to maintain a uniform policy, establishing a strict policy regarding arrests and appeals against decisions to release from custody, including in the case of minors, defining designated supervisors in the districts to ensure uniformity in treatment, weekly reporting to the Attorney General's Office on the status of cases in all districts, establishing a dedicated contact group for supervisors in the various districts, and to headquarters officials, for the purpose of sharing, consultation and updates in real time, various coordinations between the prosecutor's office and the investigation and prosecution divisions of the Israel Police, later, determining a punishment policy in relation to cases in which a conviction was obtained.

The management of the event under the direction of the headquarters, while cooperating and brainstorming with the districts, and while improving and learning lessons while in motion, resulted in the compliance of the attorney's office with this important and national task.

Indictment data

In the indictments, the defendants were charged with a variety of crimes: murder (the incident of the late Yigal Yehoshua), attempted murder, serious injury with aggravated intent, arson, endangering human life on a transportation route, weapons offenses, assaulting police officers, and public order offenses, including rioting, disturbance to the policeman and more.

In the appropriate cases, and when it could be proven, an aggravating circumstance of a racial motive was attributed to violent and property offenses committed against the background of the origin and identity of the targets of the attack. The practical meaning of attributing the motive is that the maximum penalty that can be imposed on the accused is double the fixed penalty for the same offense or 10 years in prison (whichever is easier). In this context, it should be noted that a racial motive can only be attributed to offenses for which the maximum penalty does not exceed 10 years in prison.  

In addition, in the more serious cases that included, among other things, lynching incidents, shooting at police officers or civilians, damage to essential infrastructure and services, throwing Molotov cocktails at the security forces or civilians and more, it was decided to charge the defendants with offenses under the Anti-Terrorism Law. The Anti-Terrorism Law also establishes a maximum penalty in the form of doubling the fixed penalty for the same offense, but no more than 25 years. The law also stipulates a harsher punishment for crimes punishable by mandatory imprisonment, and a harsher punishment also for the connections and aides, for those who commit acts of mass terrorism, and more.

In the aforementioned period, indictments relating to 108 incidents were filed against 239 accused of crimes under the aggravating circumstances of an act of terrorism or a racial motive, 85% of them of Arab origin and 15% of Jewish origin. A fifth of the accused were minors.

So far, in about 80 cases filed all over the country, in which the legal proceedings have ended, the defendants have been sentenced to actual prison terms for varying periods, depending on the severity of the offenses. In some cases, the attorney's office even submitted appeals to the Supreme Court about the sentence, and these were accepted and led to the severity of the punishment.
