Nir Shuver was convicted of tax offenses at the Haifa Magistrate's Court

A member of the Haifa Municipality Council, Nir Shuber, was convicted today (Monday, 30/8/2021) of tax offenses at the Haifa Magistrate's Court. Shuver was on trial for tax offenses, which he committed, according to the verdict, in the days when he ran the "Hina Kioscapa" cafe on the sea road.

The sentence will be handed down later and then we will know more about Shuver's ability to continue in his position as a member of the city council.
A hearing regarding the arguments for the punishment is set for 21/9/9 at 08:30.
An arrest warrant was written for the purpose of bringing defendant number 3 in the case: Guy Azriel (who was absent from the sentencing hearing).

Shaver is a member of Klish's faction, living in Haifa. Kalish herself was also convicted, before the elections, of construction offenses, while she worked in her previous position, as an architect.

In principle, this is a criminal offense for anything that can also end in imprisonment, see Tzipi Refaeli's entry (mother of Bar Refaeli).

In light of the criminal conviction, according to the planning and construction law, the judge must determine whether a violator can be a member of the local committee. If the judge determines that he cannot be a member of the committee, then he cannot be a member of the city council, in my estimation.

It is possible that the judge will not rule this way, by mistake, as happened in the case of Klish (when he was convicted of construction offenses in March 2018 - S.B.). The Attorney General will then have to act again.

In addition, the judge has to determine whether there is defamation and if he determines that there is defamation in the offense, in my opinion Shovar will not be able to continue to be a member of the city council. I guess he won't go to jail.

The response of attorney Yoel Goldberg, who represents Nir Shuver:

We are dealing with a technical offense of not submitting 3 VAT reports, a minor offense that does not justify any background noise
We asked to transfer the matter to the route of an administrative fine, however, in view of the payment of the fund only, the judge decided not to postpone the case any longer for the purpose of completing the administrative procedure and found it appropriate to convict.

In our opinion, he was wrong in the matter and we will look into the possibility of filing an appeal after the determination of the punishment in the case.
Nir and his partner are not responsible at all for the failure to submit the reports, but they agreed to admit the technical offense on the assumption that it would result in an administrative fine.

We will wait for a final decision on the matter and in the meantime let the good souls celebrate.

    It is impossible to let people who are involved in crimes, taxes, or offenses of any other kind, be members of the city council and the mayor.
    Just as you would not want a person with a conviction for domestic violence offenses, both convictions for tax offenses and convictions for construction offenses.
    Those who are convicted should not hold any public office, this is how it is in a reformed country. The question is whether we are a banana republic.. or a country whose public representatives will be exemplary and not convicted..

I believe that in this case it is appropriate to be punished with a monetary fine and a reprimand on conditions beyond that, to the extent that a heavy punishment is given, in my opinion, this is an unreasonable and proportionate punishment given solely because Nir is a public activist and will be given unjustly.
    Also, I believe that Nir is a good person in my opinion who gets into trouble serially, and if he had received the right advice, including legal advice, he would have solved a large part of his problems and would not have had any problems with fraud at all, and would not have had a serious ruling against him at all.
    For the sake of transparency, I represent the journalist Tali Liebman in her libel suit against Nir.

  12. An incident with a well-known Haifa contractor who failed in business in one of his big projects in Haifa. As a result, he went bankrupt and all his accounts were confiscated. Shortly before the foreclosure, he managed to collect the payments from new tenants who entered one of the buildings he built, including the VAT on the apartments, but within a few days he was unable to manage his accounts. He thought to himself that in light of the fact that there were enough funds left in the bank account being foreclosed and the tax authorities would receive from the bank the funds for the VAT payment. In his innocence, six months later he turned to the VAT offices to find out if the money had been transferred to them from the bank and thus basically "awakened the bears". A short investigation was opened and at the end of it an indictment was filed against him by the Claims Department of the Tax Authority. His luck ran out and precisely at that time the government turned to the court system and requested that the punishment for tax offenders be increased in light of the many cases of late tax payments and even demanded, "so that they will see and be seen", to avoid tax ransom payments which are widely used instead of prison sentences. The Haifa judge who came to sentence the contractor saw this as a golden opportunity to shock the entire construction industry and decided to everyone's astonishment that the contractor spent no less than a year in prison.... And so this unfortunate man found himself behind bars at the age of 70... When he arrived at Hermon prison, they did him a favor and added to his cell the former Minister of Finance who was sentenced to more than five years in prison, so that he would have a little more interest during such a traumatic period of imprisonment. In short, I do not wish that To no one and certainly not to the so-called "normative" people....
    Does it mean anything to us? Time will tell...

  18. Every self-employed person knows that financial reports must be submitted to the authorities on time. I probably assume that an accountant is also employed for the business. It does not seem that the above guy is so innocent. Conviction of a tax offense is a stain after which the man is unfit to serve as a public representative.
    If he had a conscience and morals, he would resign right now, but that requires magnanimity.
