Noise and dust hazards in Haifa: can the law protect residents who live next to a construction site?

Many residents of the city live next to construction sites and suffer from noise and dust hazards over time. Some do not know the law and do not know that there are cases in which the law can offer them relief. For some, the law cannot help, because the construction or renovation is done within the framework of the law and it still harms their quality of life.

Helen Dorfman from the law firm Helen Dorfman & Co., which specializes in real estate and civil law, explains to Hai Pa readers:

In the law there is a reference to the hours when it is allowed to make noise and the permitted volume of noise. There are certain hours and certain days when it is allowed to make noise. On weekdays it is allowed to make noise from 7:00 am to 19:00 pm. On Friday it is allowed to make noise until 17:00 only and you have to keep quiet until Sunday at 7:00 in the morning. The law also applies to religious holidays (for example, on New Year's Eve it is forbidden to make noise after 17:00, but on Hanukkah it is allowed to make noise like on a weekday). Another distinction is between reasonable and unreasonable noise. If unreasonable noise is made near you, exceeding what the law allows, you can contact the local authority. Unreasonable noise is noise above 80 decibels. The law refers to another thing: if there is an emergency or it is necessary to prevent danger, the work can be done at any hour. For example, if a crane is about to fall and endanger people at any hour, it is permissible to repair it.

Noise nuisance in Ramat Eshkol in Haifa

"A year ago, two neighbors started to renovate their apartments, which includes adding MMDs," said Tzachi, who lives in the Ramat Eshkol neighborhood, "It is not about the construction of an entire building near my house, nor an entire neighborhood, just a renovation. Other neighborhoods with long-standing complaints are Carmelia with many urban renewal projects, truck traffic during rush hours, dust and noise, and the Verdia neighborhood, which has had large-scale works for a long time, which greatly affects the quality of life.
