Residents of the city find themselves for years or months living in construction sites. Does the law offer them relief from the noise and dust?
Many residents of the city live next to construction sites and suffer from noise and dust hazards over time. Some do not know the law and do not know that there are cases in which the law can offer them relief. For some, the law cannot help, because the construction or renovation is done within the framework of the law and it still harms their quality of life.
Helen Dorfman from the law firm Helen Dorfman & Co., which specializes in real estate and civil law, explains to Hai Pa readers:
In the law there is a reference to the hours when it is allowed to make noise and the permitted volume of noise. There are certain hours and certain days when it is allowed to make noise. On weekdays it is allowed to make noise from 7:00 am to 19:00 pm. On Friday it is allowed to make noise until 17:00 only and you have to keep quiet until Sunday at 7:00 in the morning. The law also applies to religious holidays (for example, on New Year's Eve it is forbidden to make noise after 17:00, but on Hanukkah it is allowed to make noise like on a weekday). Another distinction is between reasonable and unreasonable noise. If unreasonable noise is made near you, exceeding what the law allows, you can contact the local authority. Unreasonable noise is noise above 80 decibels. The law refers to another thing: if there is an emergency or it is necessary to prevent danger, the work can be done at any hour. For example, if a crane is about to fall and endanger people at any hour, it is permissible to repair it.
Noise nuisance in Ramat Eshkol in Haifa
"A year ago, two neighbors started to renovate their apartments, which includes adding MMDs," said Tzachi, who lives in the Ramat Eshkol neighborhood, "It is not about the construction of an entire building near my house, nor an entire neighborhood, just a renovation. It is also important for me to emphasize that the neighbors who did the renovation received all the approvals and acted exactly according to the law. And we're still talking about a year of drilling at 7:00, including July and August, including New Year's Eve, terrible noise, and we didn't know what to do. I can tell exactly whether the noise is within the permissible limits or not. Some of the apartments in the building complained about dust, which regularly reached their apartments. Maybe it seems like a minor nuisance, but when you can't open windows and anyway dust gets into your house day after day, it's not easy. And everything is just a renovation."
Complaints reach the Live Mouth system from all over the city of Haifa
Over the years, in several neighborhoods in the city, residents have complained about construction and Tamaot projects, which regularly harm the quality of life. One of the neighborhoods is Remez, and especially the residents on Habiva Reich Street. Over the years, many projects have been built on the street, and the residents have complained about a difficult parking problem, the movement of heavy vehicles, dust and noise In many cases, the residents bought the apartment and knew what they were going for, and in some cases the person who bought the apartment was not fully aware of the parking difficulties, which only become apparent when they move into the apartment.
Other neighborhoods with long-standing complaints are Carmelia with many urban renewal projects, truck traffic during rush hours, dust and noise, and the Verdia neighborhood, which has had large-scale works for a long time, which greatly affects the quality of life.
"The problem is that it can happen to anyone," says Siegel, who has a clinic on Yarakon Street in the Shambor neighborhood. , and it's just a clinic, it's not like a house, where you're in all the time. A few months ago, there was some construction phase that made noise, which prevented me from working. I had to find another place for a few months because it was possible to work in the noise that was created. The problem is that there are regulations But just the thought of all the hassle often prevents her from going to the municipality and most importantly, many times everything that is done is within the law and there is nothing to do."
