The story of the illegal restaurant and construction offenses at the surfers' beach in Bat Galim - Haifa

Construction violations at the surfers' beach in Bat Galim: a developer poured rocks into the water to set up an illegal restaurant

An illegal restaurant at the Surfers' Beach in Bat Galim On Saturday we walked along the Bat Galim promenade to the cable car and arrived at the Surfers' Beach.
It's always nice there in the summer and there are a lot of surfers and kites.
To our surprise, we saw that half of the beach was destroyed by tractors that were working there.
We asked the surfers on the spot to resolve the matter and they explained that the surf club operates
Rented more than half of the beach to an entrepreneur who is making a restaurant there.
They explained that the developer wanted to dry up a part of the sea to increase the area and this robbed them of half of the beach.
The Law of the Beaches stipulates actual imprisonment for offenses allegedly committed here.

  1. A question about...
Before A.A. Inbar won a license to operate the beach in 2006, did she operate at the beach??
    As what????
I would appreciate a quick answer on the matter

  3. Perhaps the representatives of the municipality will briefly detail what the strict enforcement actions are in question. This is so that we all wait and maybe sleep peacefully.

  4. To Maya, I definitely think that you are a fool, and most likely with goals/intentions to lead in a certain direction...
And if not - read all the materials and learn this long story and you will see that it is much more than what you stated there

Summary: A franchisee who undertook to operate the beach for the benefit of surfing, did not meet many of his contractual obligations, violated the law in several gross ways, is in debt to the municipality and exploits an area designated for water sports for his own personal benefit/whim and against the law and court rulings.
On the other hand, the municipality stands and deals with the issue lazily and with a soft hand and a flagrant condescension.

So it is true that this remote beach is important mainly for the surfers who use it, but in my opinion it is also important for every resident of Haifa and citizen of the State of Israel.
Already, too many beaches in this country are being exploited by private hands that line their pockets at the expense of the public, and do not really provide any real service, and at the same time violate the rule of law in the country.

So in my opinion Duke is definitely on the right side of the story, and is investing his resources: time, nerves and money to solve something that the authorities should not have neglected, and should have solved a long time ago.
Before you declare the intentions of others and advise them, maybe check again if you are on the right side of this story.
It turns out that there are people whose goal is that the beach does end up in private hands...

  5. This thread should be accompanied by the soundtrack of the movie "The Neverending Story"
The never ending story..ahaha ahaha ahaha

  6. Whether to answer Maya or not
    Is it worth a comment?
After all, it's clear to hold a "birthday" party until midnight on the sidewalk in front of your house and charge admission to "cover expenses" : Lol:
    It is not possible
Bat Galim Beach is a public beach
The operators of the party "guys" are not honest people to say the least and this has been clear for a long time
The beach does not belong to surfers but to the entire public
And here the public will not let it happen - very simple

  7. "Khabra's group" - you made me laugh. This is not only Duke's business, it is the business of all the residents of Haifa.

  8. I don't understand why Doron Dukes thinks that this beach belongs only to Doron Dukes...why can't people from the neighborhood or Haifa in general also enjoy the beach and organize birthday parties and events at night that surely don't disturb surfers (provided they keep the beach clean). If a group of Khabra organizes and pays for the expenses 30 NIS...what is Doron Dukes's eyes, I was at the birthday party it was great...people who were walking on the beach could pass happily there were no fences and the beach was not closed at all.... and whoever said he didn't come to the party passed For fun, I find Doron Dukes to find a life for himself and concentrate on surfing.

  9. To Mrs. Ruthie Sussman's strange answer which she received from our legal advisors.

    WANTED
    =======

Wanted someone who saw the representatives of the municipality carry out actions to prevent the recurrence of illegal activity at the surfers' beach

  10. A denied answer from the lawyer of the municipality, which of course she and her partners in the office, for their convenience, ignore everything that was photographed in the field, and from the first paragraph of the letter dated 16/05/2010, and I quote part of it:
"... infrastructure work, such as planting grass and placing furniture..."
Of course, those who sit in the office (which I assume is not badly air-conditioned), and do not want to go outside, cannot see what is happening on the beach.

  11. Dear Doron,

Just for your information, without proof of collecting money on the spot from the audience, the legal situation is much less significant.
Any testimony about the closing of the place and the collection of an entrance fee and the sale of products and drinks makes their situation worse from a legal point of view!

  12. Probably the answers you are looking for Ron Ron are on this page,
But only if you want discounted tickets for fun
Because after all this topic, the municipality is looking for proof, we work for them.

  13. Can anyone testify that they charged money upon entering the place?
Did they sell drinks or any other product on the premises? Or hand out free drinks to everyone who was invited..

Were people prevented from passing through the area?

    Were there paid security guards?

Please urgently provide more details so that we can check the legality of the matter!

    Thanks!

I spoke at noon with the policemen who came to the beach. They said they came to confirm the event in terms of safety and it is none of their business if public space is taken over, it is the municipality's business.
Around ten I went to a party that was alive and well, and I asked a girl named Naama (probably a fake name) at the entrance what was the matter, and what authority does she take 30 NIS for entrance to a public beach, but apart from her I didn't see any gorillas.
I called the municipal supervision and explained the situation, and he gave me the puzzling answer that no supervision works during these hours. I tried to remind him that the supervision works 24/7 and I don't remember that on Saturday I can, for example, park where I want or do whatever brothel I want. He promised to send the rangers (?) to check the place.
    Haifa Municipality Toy Municipality.

    you understand

  15. Does anyone know why instead of a trance party there were only police today? : Shock:

  17. You see here a complete microcosm of the enforcement of planning laws in the State of Israel
The procrastination, the orders, the invasion of territories, deviation from zoning, the attempts at rejection, the beeping of the law..
Simply, all the classic elements of the design mode

  18. Of course, the Avrach forum will not help us
Spare us jokes about blondes, let's go and have fun, we all know
That the grass is new, it is forbidden to step on it.

  19. Closing the beach is a brazen and blatant step on the part of the restaurant operators. They show a triple finger to the municipality, the surfers, the residents of Bat Galim and the general public who cares about the rule of law and keeping the beaches open to all. The precedent of the Kinneret shores serves as a candle to the feet of these criminals and for them it is only the opening shot for closing the beach with increasing frequency. If we give up on them, they will consider it a success. You have to "give them a head" as much as possible. Something will have to break - them or us and I don't see the second option materializing.

  20. I went through the documentation here on the site.
It turns out that a warning was sent to the legal department with photographs of new works in the field a week ago.
So where are the enforcement measures?

  21. [quote="Haifa Municipality":pbusktqf]For: live here
The operating agreement between the municipality and the franchisees was canceled following flagrant violations of the agreement by the franchisees and violations of the planning and construction law committed on the spot.
Legal proceedings were taken against the franchisees which led to the closure of the restaurant that operated there.
Currently, an eviction lawsuit is being filed against the concessionaires and the municipality will continue to take all measures at its disposal to enforce the law and continue to protect the beach.

I am surprised that the municipality responded at all. But according to the pictures we saw from the field, and what is written here, it seems that not only does the municipality have no means to enforce the law, etc., it also has no means to write a (short!) message without disruptions:
"Legal Proceedings", "And the Municipality will continue"
I will remind our dear municipality:
    1. Police
    2. Intelligent use of the barges' huge budget.

  22. I ran there yesterday and saw that they had a trance party. Did someone say closing order?

  24. XXX of the Kiryats paid the guards XXX to prevent the Israelis from entering the coast.
Yona Yahav where is the law?

  25. Haifa is indeed crying today
    Literally
The sane majority that holds this country on its shoulders
Makes reserves, fights in Israel's wars, works and studies
Robbed time and time again by one minority or another
in a criminal and vile way
    It happens everywhere
The wicked are gloating at the expense of our freedom because of our indifference
There are no enforcement or execution authorities
There is no law and no justice

  26. Editor's note
Just a week ago, Judge Verbner ordered a suspension of use of the property (the diving club at the surfers' beach).

    Editor's note
These photos were obtained from the surfers' website. You can see that the beach has been closed to pedestrian traffic since the afternoon hours. Just to remind you, this is a public transport network.
I wonder if the Haifa municipality approved this activity and the closing of the area. We will ask for a response.

Security guards have been blocking public access with barricades since noon

  27. It seems that someone decided to close the surfers' beach
And it seems that there is no authority handling the matter
The surfers' beach in Bat Galim was closed by a line of security guards stationed on all sides of the beach
    every 10 meters
and prevented people from entering the entire compound
Not for swimming, not for wandering, not for any activity, except for an entrance fee for a trance party that takes place on the beach
what is happening in this city
There is no law and no justice
It seems that there is no problem for any criminal to take a piece of beach and expropriate it from the public
The pictures are in front of you - taking pictures is also prohibited

  28. And now the pictures, it's hard for me to believe that I'm doing and seeing this again.
Sunset that the court is looking for her with Guy Malka, a skinner, a lattice builder,
Bona Dak, I feel like throwing up from the conduct of the municipality, that something would put an end to it already,
According to the court's decision, no one is allowed to touch the structure.

  29. Today the deck was rebuilt
Of course, the legal advisor Adv. Rashef Chen receives information
    and the world is silent
Pictures coming soon, I'm starting to run out of words

  30. I don't understand, why did the municipality wage a fight if under its nose the same developer who whistles about the law returns to the area and opens again?!
Is it possible to get a response from the municipality to what is being filmed here?!
